Is BIVETY a law firm? No. BIVETY is a commercial recovery consultancy. We act strictly as commercial recovery consultants and do not provide regulated legal services, legal advice, or court representation.
What exactly does BIVETY do? We provide a structured, enforcement-led approach to recovering unpaid Judgment Debts by managing administrative complexities such as court filings, asset tracing, and debtor engagement.
Do you attend court or represent clients? No. Our role is limited to the administrative coordination of enforcement proceedings and commercial negotiations.
Why do you show court processes on your marketing if you’re not a law firm? These descriptions are high-level and intended to inform clients of the enforcement roadmap while clarifying that we do not provide legal advice.
What specific recovery actions do you coordinate? We coordinate actions such as identifying garnishee targets (banks and customers), conducting Examination of Judgment Debtor (EJD) to force asset disclosure, and filing statutory demands.
How do you find the debtor's assets? We conduct Bizfile, corporate, and asset searches to identify bank accounts, customer debtors, and related entities.
Do you "freeze" debtor funds? No. Only court-directed processes can attach funds. We coordinate the court-directed attachment steps and related administration.
Will BIVETY talk to the debtor for me? Yes. Our service includes advising on negotiation strategies and liaising directly with the debtor or third parties on your behalf for recovery purposes.
What does "Pay Only If We Recover" mean? This refers to our Success Fee of 25%, which applies only to sums successfully recovered, secured, or settled. If no money is recovered, the success fee does not apply.
What if the debtor pays me directly? The 25% success fee remains payable in full if recovery occurs during the engagement period, even if funds are received directly by the Client.
What are "Disbursements"? These are actual out-of-pocket costs such as court filing fees, search fees, and process server fees. These are payable at cost and must be reimbursed regardless of the recovery outcome.
What is the payment timeline? Success fees must be paid within 7 days of the recovery, and disbursements must be paid within 7 days of the invoice. Overdue amounts accrue interest at 10% per annum, computed daily.
Is there an exclusive period for your services? Yes. BIVETY requires an exclusive period of 3 months from the date of engagement to conduct all recovery efforts relating to the debt.
What does exclusivity mean for me? During this 3-month period, you agree not to engage any other agent, consultant, or advisor for the same debt without BIVETY's written consent.
What if I want to stop the recovery process early? You must provide prior notice before withdrawing or compromising a claim. If recovery happens within 6 months of termination due to BIVETY's prior work or strategy, the success fee is still payable.
What are my other responsibilities? You must provide all required documents, sign affidavits promptly, and notify us immediately of any payments or contact from the debtor.
Is my information protected? Yes. All information exchanged is kept strictly confidential, and this obligation survives termination indefinitely.
